1. Agreement and App Store terms

These Terms of Use ("Terms") are an agreement between you and the developer of Caffeine Tracker ("Caffeine Tracker," "we," "us," or "our") concerning the Caffeine Tracker iOS and iPadOS application (the "App"). Apple is not a party to these Terms.

These Terms supplement Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA"). If these Terms conflict with the Apple Standard EULA, the Apple Standard EULA controls to the extent of the conflict. Apple and its subsidiaries are third-party beneficiaries of the Apple Standard EULA and may enforce it.

2. Eligibility

You must be at least 13 years old to use Caffeine Tracker. If you are under the age of legal majority where you live, you may use the App only with permission from a parent or legal guardian. The App is not designed for children and should not be used to encourage caffeine consumption by minors.

3. Limited license

Subject to these Terms and the Apple Standard EULA, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, as permitted by the App Store Usage Rules.

You may not copy, sell, rent, sublicense, distribute, reverse engineer, interfere with, or attempt to gain unauthorized access to the App, except where applicable law expressly permits it.

4. What Caffeine Tracker provides

Caffeine Tracker lets you record caffeine and water intake, view history and progress, estimate caffeine remaining in your body, set daily goals and taper plans, and schedule local reminders. Some features are available only with Caffeine Tracker Premium.

Caffeine Tracker may use published reference values and mathematical models to estimate caffeine content, caffeine half-life, bedtime levels, and related insights. Actual caffeine content and individual response vary by product, preparation, serving size, metabolism, medication, health, pregnancy, and other factors.

5. Health and medical disclaimer

Do not use Caffeine Tracker to make urgent medical decisions. Consult a qualified healthcare professional before changing caffeine intake, especially if you are pregnant or breastfeeding, under 18, taking medication, sensitive to caffeine, or living with a heart, sleep, anxiety, neurological, or other medical condition.

If you experience concerning symptoms or believe you may have consumed a dangerous amount of caffeine, stop using the App as a decision tool and contact local emergency services, a poison-control centre, or a qualified healthcare professional.

6. Your responsibilities

You agree to:

• Enter and review information carefully.
• Use your own judgment and verify product labels or manufacturer information when accuracy matters.
• Use the App only for lawful, personal purposes.
• Protect your device and Apple Account from unauthorized access.
• Avoid disrupting the App or attempting to bypass Premium access, purchase validation, or security measures.

7. Premium, subscriptions, and purchases

Caffeine Tracker may offer weekly and yearly auto-renewable subscriptions and a one-time lifetime purchase. Available plans, features, prices, billing periods, and any introductory offer are displayed in the App before purchase. Prices may vary by country and include applicable taxes.

• Payment is charged to your Apple Account when you confirm the purchase.
• Auto-renewable subscriptions renew automatically unless you cancel at least 24 hours before the end of the current billing period. Apple may charge your account for renewal within 24 hours before that period ends.
• If the App displays a three-day free trial and Apple confirms that you are eligible, payment is not charged for the subscription until the trial ends. The subscription then renews at the price shown unless cancelled before the trial ends.
• You can manage or cancel a subscription in your Apple Account's subscription settings. Deleting the App does not cancel a subscription.
• A lifetime purchase is a non-consumable App Store purchase that unlocks the applicable Premium features for the supported life of the App. It is not a promise that the App or every feature will be available forever.
• Use Restore Purchases in the App to restore eligible purchases associated with your Apple Account.

Apple handles billing, cancellations, and refunds. Refund requests are subject to Apple's policies and applicable law. Caffeine Tracker does not receive or store your payment-card details.

8. App content and intellectual property

The App, including its design, software, artwork, branding, compilations, and original content, is owned by or licensed to us and is protected by applicable intellectual-property laws. Product names and trademarks belonging to third parties remain the property of their respective owners. Reference to a beverage or source does not imply sponsorship or endorsement.

You retain responsibility for notes and other text you enter. You grant us no rights to local content that never leaves your device.

9. Third-party services

Caffeine Tracker relies on Apple for distribution and in-app purchases and on RevenueCat for purchase validation and Premium entitlement management. Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

10. Changes and availability

We may improve, modify, suspend, or discontinue parts of the App, add or remove features, or update these Terms. We will not intentionally deprive you of an active paid entitlement without providing the access or remedy required by applicable law and App Store rules.

Updated Terms apply from the effective date shown above. If a material change requires notice or consent, we will provide it through the App or another appropriate channel.

11. Disclaimers

To the maximum extent permitted by law, Caffeine Tracker is provided "as is" and "as available," without warranties of accuracy, reliability, availability, fitness for a particular purpose, or uninterrupted operation. Nothing in these Terms excludes warranties or consumer rights that cannot legally be excluded.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive loss, or for loss of data, profits, goodwill, or business arising from your use of or inability to use the App, reliance on an estimate, or a third-party service. Our liability is not limited where doing so would be unlawful, including where applicable law does not permit a limitation for fraud, wilful misconduct, or certain personal injury.

13. Termination

You may stop using the App at any time. We may suspend access if you materially violate these Terms, attempt fraud, or misuse the App. Terms that by their nature should survive termination—including ownership, disclaimers, and limitations of liability—will survive. Termination does not automatically cancel an App Store subscription; subscriptions must be cancelled through Apple.

14. Applicable law

These Terms are governed by the laws applicable where the developer is established, without regard to conflict-of-law rules, except that mandatory consumer protections and jurisdiction rights in your country of residence continue to apply.
